Manufacturers of vehicles clude the cost of any repcements that which might occur durg the warranty period. Now if any product requires any repcement and that is done without conration.Should it be treated as sale the hands of authorised dealer of the vehicles. '

Eligibility for Deduction U/s 24 (b) for the housing loan interest – (DIRECT TAXES)
Facts of the Case : -A husband has purchased a property the name of her wife just to save the stamp duty cost. -The Property was fanced by ICICI bank jot names i.e the name of wife and husband. - The down payment as well as all the EMI are beg paid by the husband from his SB A,c. - Wife is also workg, but has not taken any benefit her I.T.urn for the terst so paid u,s 24(b) of the IT Act or the tax rebate for the prcipal u,s 88 of the Act. The Query is : Whether the husband is eligible to cim his come Tax urn , the ter so paid u,s 24 up to a Max. of Rs. 1.5 cs as well as the tax rebate for the Prcipal so paid up to a max. of Rs. 20000,- u,s 88 of the Act. If so, is there any case w support of it. '

Corproation - PSU whose come is exempted under section 10(26B) of the come Tax Act, 1961 has cimed to a bank (where the PSU is keepg FDRs ) that No Tax should be deducted from the ter payable on them sce the whole come of the PSU is exempted from tax. Kdly guide me whether the stand of the PSU is correct or TDS requirements are dependent from the provisions of the assessment of the total come of the Corporation. '

INTRODUCTION OF PARTNER"S CAPITAL IN FIRM – (DIRECT TAXES)
A partner a firm had purchased a plot of nd his dividual capacity before the partnership deed was executed. The Firm then agreed (oral agreement) to undertake division of the Plot to sub-plots and sale therefater on as is where is condition or after development (as per requirements of ers). The plot of nd has been shown as capital troduced (by way of stock trade) by the partner the books of the firm at agreement value. It is proposed to have a tripatriate agreement between the owner of the plot (i.e. the patner), the developer (i.e. the firm) and the ers of the sub-plot to effect the transfer of right property. Now the quions arisg are: (1) With regard to the capital contribution by the partner, what would be the capital Gas implication the hands of the firm, if the cost of the plot is taken the books of the firm as the value of capital troduced? Whether it is appropriate to show such capital as stock Hand? (2) Would there be any other tax implication (whether to the firm or partner)? '

Can a company come into existance with loans from directors and building in its balance shete on the date of incorporation? – (CORPORATE & OTHER LAWS)
Few people (all r directors) formed a pvt. ltd. co. its pre-corporation stage, they contributed their money and constructed a buildg on the nd of a director. The buildg was completed on 1st April 2001 and company was corporated 17th May 2001. When the buildg was constructed no ownership title was given to the buildg by the directors. the company has given the same buildg on lease WEF 1st April 2001 and the company is enjoyg lease rentals till today. The directors have no objections and taken the stand that, the company owns the buildg by takg loans from directors. technically, Who is the owner of the buildg. Directors theire jot capacity or company? who has title to the buildg? Can a company be corporated with loans from directors liability and buildg on its assets on the date of corporation. the lease is matured and contuation is accepted by leasee. Is it void? What is the solution to this situation. what options are avaible with the directors.What is the duty of auditors? '

My query is ed to the Quion 1409 asked by Mr.Desh Guti and the same was answered by Mr. Bhojwani Statg that Non Agr come 101230 and agr come 40000 is to be clubbed for the purpose of calcutg TAx which came out to be RS.17246 out of which Rs.7000 rebate on a,c of agri come was given out of bance Rs.10246 further rebate of 88D Rs.9016 was provided i just want to clear that rebate u,sec88D is to be provided applyg formu {Tax on Net come-(Net come-100000) the above query, Tax on net come is taken as 10246 ie for this purpose net come is 141230 right,then how come the net come is taken 101230 stead of 141230. '
