One of my client is DSA (Direct Sales Team) of a Private Sector Bank. We have cimed benefit of exemption of Rs. 4 cs as his turover was less than Rs. 4 cs durg F.Y. 2004-05. Dept. says exemption benefit will not be avaible to him as it is brant name. Is dept. justified ? '

Deduction of TDS u/s 194C in case of Indiviuals – (TDS/TCS)
Dear Friends, An diviual is liable for Tax audit as his gross t,o exceeds Rs. 40 cs. Hence as per TDS rules, he is liable to deduct TDS on payment made to contractors like job worker etc. While gog through IT ready reckoner AY 2005-06,06-07 of Dr V K sghania, foot note below Para 156, it says that case of diviual havg Tax audit TDS liability is only for 194C(2) i.e. supply of bours. Does it mean that for other contractors TDS is not applicable u,s 194C except 194C(2). Pls discuss. '

STPI – (DIRECT TAXES)
Dear Members, My client is exportg software to USA sce 2003.He purchased 20 computers for this 2003.He did not register then with STPI. Now he wishes to register with STPI. can he do so. such case whats the relevance of the followg text appearg the section 10A. It should not be formed by transfer to a new busess of machery or pny previously used for any purpose It should not be formed by splittg up or reconstruction of busess already existence. That means cant we use the old computers? do we need to new computers. Kdly crify if any one is expert above. Regards Raghu '

Conversion of stock in trade to capital asset – (DIRECT TAXES)
A Company which was formed for the purpose of dealg immovable property was carryg on such busess for quite sometime and the stopped the same for some years.Can the unsold part of immovables be reconverted as capital assets so that the capital ga arisg on sale of such property be ved under appropriate bonds for cimg exemption? While there is a specific section cometax Act deals with conversion of capital asset to stock trade,their liability to capital gas tax and which part of the ga is to be treated as busess come etc., the w is silent on the conversion of stock trade as Capital asse? REMUNERATION TO THE FOUNDER TRUSTEE OF A PUBLIC CHARITABLE TRUST – (DIRECT TAXES)
One of my clients is a Public Charitable Trust registered u,s 12 A(a).It is runng a hospital a rural area. As per one of the cuses of the Trust Deed,no funds or other property of the Trust shall be paid to or distributed among the trustees,nomees but shall be applied towards the furtherence of the objects of the trust or for any charitable purposes. The founder Trustee is performg the day to day activities of the Trust.He tends to draw a remuneration of Rs.10000,- pm towards services rendered by him. Please advise if it is correct. '
